Title 42 Policy Struck Down

On November 15, 2022, US District Court Judge Emmet G. Sullivan struck down the Title 42 border expulsion policy as “arbitrary and capricious.” Issued in March 2020 as a response to the Covid-19 pandemic, the policy allowed US border agents to turn away millions of migrants who presented themselves to authorities without giving them a chance to seek asylum. Judge Sullivan suspended the decision for five weeks, so Title 42 border expulsions will end in just over a month on December 21, 2022.
