Doyle Memorandum on New Prosecutorial Discretion Guidance Takes Effect Today

The recent memo to US Immigration and Custom Enforcement (ICE) Office of the Principal Legal Advisor (OPLA) attorneys assigned to handle proceedings before the Executive Office for Immigration Review (EOIR) on civil immigration enforcement and prosecutorial discretion — known informally as the Doyle Memorandum — takes effect today, April 25, 2022. The guidance aims to direct the agency’s resources to enforcement priorities “to ensure that finite [Department of Homeland Security] resources are used in a way that accomplishes the Department’s enforcement mission most effectively and justly.”
